2. Scope

This policy applies to personal data we process about visitors to our website, account holders, and people whose data is provided to us through use of the Service. It does not cover third-party websites or platforms that have their own policies. "Personal data" means information that identifies or relates to an identifiable individual.

4. Where we get it

We collect data directly from you, automatically as you use the Service, and from third parties such as Advertising Platforms you connect, our payment processor, and authentication providers (for example when you sign in with Google).

We do not sell your personal data, and we do not use your private business data or uploaded content to train third-party AI models for purposes unrelated to providing the Service.

Where the GDPR or UK GDPR applies, we rely on: performance of a contract (to provide the Service); consent (for optional marketing and any non-essential cookies, which you can withdraw); legitimate interests (to secure, improve, and promote the Service, balanced against your rights); and legal obligation (to comply with law).

We use trusted sub-processors to deliver the Service, including categories such as cloud hosting and storage, AI/model providers, payment processing, email/communications, and error/analytics tooling. We require each to provide appropriate safeguards. A current list of sub-processors is available on request at support@flashperfection.com, and we will give notice of material changes where required.

9. Connected ad platforms

When you connect a platform such as Meta or Google Ads, your use of that platform is also governed by its own terms and privacy policy. You can disconnect a platform at any time from your account settings, which revokes our ongoing access. We use platform data only to provide the Service to you and in line with each platform's developer/data policies.

We are based in the United States and may process and store data in the U.S. and other countries whose laws may differ from yours. Where we transfer personal data from the EEA, UK, or Switzerland, we use appropriate safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum), or another lawful transfer mechanism. We keep personal data for as long as your account is active and as needed to provide the Service, then for the period required to meet legal, tax, accounting, or reporting obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by data type — for example, account data is kept for the life of the account plus a limited wind-down period, and billing records are kept for the period required by law. You can ask us to delete your account and associated data, subject to those obligations.

We use technical and organisational measures designed to protect your data, including encryption in transit, hashed passwords, access controls, least-privilege handling of platform tokens, and monitoring. No method of transmission or storage is 100% secure, but we work to protect your information and to notify you and regulators of incidents where the law requires.

Depending on where you live, you may have the right to access, correct, delete, or export ("port") your data; to object to or restrict certain processing; to withdraw consent; and not to be subject to unlawful automated decisions. To exercise any of these, email support@flashperfection.com; we may need to verify your identity. You also have the right to lodge a complaint with your local data-protection authority. We will respond within the time required by applicable law (generally one month under the GDPR).

14. US state privacy rights (CCPA/CPRA & others)

If you are a resident of California or another U.S. state with a privacy law, you may have rights to know, access, correct, delete, and obtain a portable copy of your personal information, and to opt out of "sale" or "sharing" of personal information and certain targeted advertising. We do not sell your personal information and do not share it for cross-context behavioural advertising. We do not knowingly process sensitive personal information for purposes that require an opt-out. You may exercise your rights — without discrimination for doing so — by emailing support@flashperfection.com; you may use an authorised agent, and we will verify requests as the law requires.

15. Automated decision-making

The Service uses automated processing and AI to generate recommendations and creatives. These tools assist you and do not produce legal or similarly significant effects about you without human involvement; you remain in control and approve what goes live. If we ever introduce solely-automated decisions with significant effects, we will provide the information and safeguards the law requires.

We use cookies and similar technologies as described in our Cookie Policy. We currently use only strictly-necessary and functional cookies and do not run analytics or advertising cookies on the site.

17. Children

The Service is not directed to anyone under 18, and we do not knowingly collect data from children. If you believe a child has provided us data, contact us and we will delete it.

If a personal-data breach is likely to result in a risk to your rights, we will notify the relevant supervisory authority and, where required, affected individuals, within the timeframes set by applicable law.

19. Changes

We may update this policy from time to time. If changes are material, we will notify you by email or in the Service before they take effect. The "last updated" date shows the latest revision.
